By using the Site or our services, you acknowledge that you have read and understood this Privacy Policy. If you do not agree, please do not use or access our services.

For privacy-related enquiries, please contact us at: hello@theawkn.com

3. Personal Information We Collect

The personal information we collect depends on how you interact with us. We collect information in the following ways:

3.1 Information You Provide Directly

  • Basic contact details: name, email address, phone number, billing and shipping address
  • Order information: purchase details, payment confirmation (we do not store full payment card details – this is handled by our payment processors)
  • Account information: username, password, security questions if you create an account
  • Communications: any messages, enquiries, or feedback you send us

3.2 Information Collected Automatically

When you visit our Site, we automatically collect certain technical data, including:

  • IP address and approximate location
  • Browser type, operating system, and device information
  • Pages visited, time spent on site, and referring URLs
  • Cookies and similar tracking technologies (see Section 7 below)

3.3 Information from Third Parties

We may receive information about you from the following third parties:

  • Shopify – our e-commerce platform, which processes store and payment data
  • Amazon – where you purchase via our Amazon storefronts
  • Payment processors – to confirm payment and prevent fraud
  • Google – via Google Analytics and Google Ads, to measure site performance and advertising effectiveness
  • Meta – via Meta Pixel, to measure and optimise our advertising campaigns

We may also permit third parties and services providers to use Cookies on our Site to better tailor the services, products and advertising on our Site and other websites.

4. How We Use Your Personal Information

We use your personal information only where we have a lawful basis to do so under the UK/EU GDPR. The purposes and their corresponding legal bases are set out below:

4.1 To fulfil your orders and manage your account

Legal basis: Performance of a contract. We use your name, address, payment confirmation, and contact details to process orders, arrange shipping, handle returns, and send you order and account notifications.

4.2 To provide customer support

Legal basis: Legitimate interests (to respond effectively to customers and maintain our business relationship with you). We use your contact details and communication history to respond to your enquiries.

4.3 To send marketing communications

Legal basis: Consent. Where you have opted in, we will send you promotional emails or SMS messages about our products, offers, and brand news. You can withdraw consent at any time by unsubscribing from emails or replying STOP to any SMS. Withdrawal of consent does not affect the lawfulness of any processing carried out before withdrawal.

4.4 To analyse and improve our Site

Legal basis: Legitimate interests (to understand how our Site is used and improve the experience for customers). We use Google Analytics to collect anonymised usage data. We have assessed that this processing does not unduly affect your privacy rights, given that the data is aggregated and not used to make decisions about you individually.

4.5 To deliver and measure targeted advertising

Legal basis: Consent (where cookie-based tracking is used). We use Google Ads and Meta Pixel to serve advertisements on third-party platforms and to measure the effectiveness of those campaigns. This processing only occurs where you have consented via our cookie banner. You can withdraw consent at any time (see Sections 7 and 8).

4.6 To detect and prevent fraud

Legal basis: Legitimate interests and legal obligation. We use IP addresses and order information to screen for potentially fraudulent or high-risk transactions. We have a legitimate interest in protecting our business and customers from fraud.

4.7 To comply with legal obligations

Legal basis: Legal obligation. We retain certain records (e.g. transaction data) to comply with applicable tax, accounting, and regulatory requirements.

5. How We Share Your Personal Information

We do not sell your personal information. We share it only in the following circumstances:

  • Service providers: Shopify (store platform), payment processors, fulfilment and logistics partners, email and SMS marketing platform providers, and analytics providers. All third-party processors are required to handle your data in accordance with data processing agreements and applicable law.
  • Amazon: Where you purchase via our Amazon storefronts, Amazon acts as an independent data controller. Amazon’s own privacy policy applies to the data they collect in that context.
  • Google: We share data with Google via Google Analytics (site analytics) and Google Ads (advertising measurement). Google’s use of this data is governed by Google’s Privacy Policy. You can opt out at any time (see Section 8).
  • Meta: We share data with Meta via Meta Pixel for advertising measurement and optimisation. Meta’s use of this data is governed by Meta’s Data Policy. You can opt out at any time (see Section 8).
  • Legal compliance: Where required by law, court order, or a regulatory authority.
  • Business transfers: In the event of a merger, acquisition, or sale of assets, your data may be transferred to a successor entity. We will notify you in advance where required by law.

6. Where Your Data Is Stored

We store and process your personal data within the UK and European Economic Area (EEA).

Some of our third-party service providers (including Shopify and Google) may process data on servers located outside the UK/EEA. Where this is the case, those providers are responsible for ensuring appropriate safeguards are in place under their own data processing agreements with us, including Standard Contractual Clauses or equivalent mechanisms approved under UK/EU GDPR.
